Between Foreign Investors & The Indian State / State Entities
India, despite the effect of the COVID-19 pandemic, remains one of the top destinations for investments globally. However, a rise in investments in India goes hand in hand with a rise in disputes between foreign investors and the Indian State. While the Vodafone and Devas sagas have shed immense light on the role of arbitration in resolving Investor-State disputes, several dispute resolution means remain available to foreign investors. In the backdrop of a dynamically evolving Indian jurisprudence, a foreign investor deciding on which dispute resolution mechanism to adopt needs to consider a myriad of legal and practical factors.
