FAQ – PRODUCT LIABILITY REGIME – INDIA
SUMMARY
The Ministry of Consumer Affairs, Food and Public Distribution notified the Consumer Protection Act, 2019 (“CPA 2019”) with effect from July 20, 2020 with certain provisions coming into effect on July 24, 2020. The CPA 2019 replaces the Consumer Protection Act, 1986 (“CPA 1986”) bringing about seminal changes in the consumer protection regime. An important new area, particularly for manufacturers and exporters to India, is the ‘product liability regime’ introduced under this law. NDA has prepared a Frequently Asked Questions (“FAQ”), answering questions which are critical for those selling products in India. The FAQs deal with the kinds of products covered, who can initiate product liability claims, determination of liability and possible defenses in the event of a product liability claim.
